DRAFT WORDING — to be reviewed and completed by Abbleys Solicitors before publication

Terms & Conditions

These terms govern your use of the Manchester Airport Claims claim service for the Manchester Airport Group data breach.

Version [1.0] · Last updated [DATE]

1. Who we are

Manchester Airport Claims is a trading name of [COMPANY NAME] LTD, a company registered in England and Wales under number [00000000], with its registered office at [REGISTERED ADDRESS]. We are authorised and regulated by the Financial Conduct Authority for regulated claims management activities under firm reference number [000000]. In these terms, “we”, “us” and “our” mean Manchester Airport Claims, and “you” means the person submitting a claim.

2. What our service is

We provide a free service that does three things:

  • we ask you a short set of questions to see whether your circumstances fit the Manchester Airport Group data breach claim;
  • we collect your contact details and your consent; and
  • with that consent, we introduce your claim to Abbleys Solicitors, a firm authorised and regulated by the Solicitors Regulation Authority under number [000000].

3. What our service is not

We are not a law firm and we do not give legal advice. Nothing on this website is legal advice, and nothing we say is a promise that your claim will succeed or an estimate of what it might be worth. Whether a claim is viable, and what it is worth, is a matter for Abbleys Solicitors after they have reviewed your case. Abbleys are under no obligation to accept your claim.

4. Passing your claim to Abbleys Solicitors

When you tick the consent box and sign at step two, you are instructing us to pass to Abbleys Solicitors the information you gave us: your name, telephone number, email address, your answer about the Manchester Airport Group notification email, your signature, and the date and time you signed.

Abbleys will then contact you directly. Before they do any work on your claim they will send you their own client care documents and a conditional fee (“no win, no fee”) agreement, which you must read and sign separately. Your relationship for the claim itself is with Abbleys, not with us.

You may withdraw this consent at any time by emailing [privacy@manchesterairportclaims.co.uk]. Withdrawing consent does not affect anything already lawfully done before you withdrew it, and if Abbleys have already opened a file you will need to speak to them as well.

5. What it costs you

You pay Manchester Airport Claims nothing, at any point. We do not charge you a fee for the introduction and we will never ask you for a payment, a card number or your bank details.

We are paid by Abbleys Solicitors. Where Abbleys accept a claim we introduce, they pay us a referral fee of [£XX / XX%]. This fee is paid by Abbleys out of their own costs and [does not / does] increase what is deducted from your compensation. You are entitled to ask us for the exact figure that applies to your claim.

If your claim succeeds, Abbleys will deduct a success fee of up to [XX]% of your compensation under the no win, no fee agreement you sign with them. Abbleys will set that out in full before you commit to anything. If your claim does not succeed, you pay nothing, subject to the terms of that agreement.

6. Your right to cancel

Because you are agreeing to this service at a distance, you have a statutory right to cancel within 14 days of signing, without giving a reason and without any charge.

To cancel, email [cancel@manchesterairportclaims.co.uk], write to us at the registered address above, or call [0800 000 0000], quoting your reference number. You do not have to use any particular form of words. We will confirm your cancellation in writing and stop processing your claim. Cancelling with us is not the same as cancelling with Abbleys once they have opened a file — their client care pack explains how to end their retainer.

7. Your responsibilities

By submitting the form you confirm that you are aged 18 or over, that the information you have given is true and complete to the best of your knowledge, and that no other firm is already instructed to act for you in relation to this breach.

You should tell us or Abbleys promptly if your contact details change, or if you become aware of anything that affects your claim — for example if another firm contacts you about the same breach.

8. Electronic signatures

The signature you draw on screen is an electronic signature and is legally effective under the Electronic Communications Act 2000. We record it together with the date, the time and the technical details of your submission, and we send you a copy by email. You can ask us for a further copy at any time.

9. Your data

How we handle your personal information — what we collect, why, who we share it with and how long we keep it — is set out in our Privacy Policy, which forms part of these terms.

10. If something goes wrong

If you are unhappy with anything we have done, please tell us first. Email [complaints@manchesterairportclaims.co.uk] or write to the registered address. We will acknowledge your complaint promptly and give you our final response within eight weeks. Our full complaints procedure sets out the detail.

If you are still unhappy, or we have not replied within eight weeks, you can refer your complaint free of charge to the Financial Ombudsman Service, Exchange Tower, London E14 9SR — 0800 023 4567 — financial-ombudsman.org.uk. Complaints about Abbleys Solicitors should go to Abbleys first and then, if unresolved, to the Legal Ombudsman.

11. Our liability

We take reasonable care in operating this service, but we are an introducer: we are not responsible for the conduct or the outcome of the legal work carried out by Abbleys Solicitors, and we are not liable for the failure of a claim. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you is limited to [£XXX].

12. Changes and governing law

We may update these terms from time to time. The version that applies to you is the one published when you submitted your claim; we keep previous versions and will send you a copy on request.

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that if you live in Scotland or Northern Ireland you may bring proceedings in your local courts.

Manchester Airport Claims is not affiliated with, endorsed by, or connected to Manchester Airport Group or any airport it operates. We refer to Manchester Airport Group only to identify the organisation against which a claim may be made.
